1. INTRODUCTION AND SCOPE
1.1. This Privacy Policy ("Policy") governs the collection, use, processing, storage, disclosure, and protection of personal data and other information obtained through the Pilatix mobile application ("App," "Application," or "Platform"), operated by Pilatix and its operators ("Company," "we," "us," or "our").
1.2. This Policy applies to all users who download, install, access, browse, register, subscribe to, or otherwise use the App or any related services ("Services"), regardless of location or device.
1.3. By downloading, installing, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by this Privacy Policy. If you do not agree to this Policy, you must immediately cease all use of the App and delete it from your device.
1.4. This Policy should be read in conjunction with our Terms of Service, which form an integral part of your agreement with us.
1.5. We reserve the right to modify this Policy at any time. Material changes will be communicated through the App or via email. Your continued use following any modifications constitutes acceptance of the updated Policy.
2. INFORMATION WE COLLECT
2.1. We collect various types of information to provide, maintain, improve, and personalize our Services. The information we collect falls into several categories as described below.
2.2. Information You Provide Directly. When you register, create a profile, use our Services, or communicate with us, you may provide account information including your full name, email address, phone number, password (which is stored in encrypted form), profile photograph, and username or display name. You may also provide demographic information such as your date of birth, age, gender, country and region of residence, and preferred language. Additionally, you may provide physical and fitness information including your height, weight (current and goal), body measurements, Body Mass Index (BMI), fitness level (beginner, intermediate, or advanced), physical activity frequency, workout preferences and goals, target areas (such as core, flexibility, or strength), preferred workout duration, and available equipment.
2.3. Health-Related Information. You may voluntarily disclose health-related information including your general health status, physical limitations or injuries, pregnancy or postpartum status, medical conditions affecting your exercise ability, medications affecting physical activity, and post-surgery recovery status. This information is provided at your sole discretion and is used exclusively to personalize your experience and ensure your safety.
2.4. Payment Information. We store information related to your purchases including purchase history, subscription status and type, transaction IDs from App Store or Google Play, and billing history. Credit card details and payment credentials are processed directly by Apple App Store or Google Play Store and are never stored on our systems.
2.5. Communication Data. We collect information from your communications with us including customer support inquiries, feedback and reviews, survey responses, and email correspondence.
2.6. Information Collected Automatically. When you use the App, we automatically collect device information including your device type, manufacturer, model, operating system and version, unique device identifiers (such as Device ID, IDFA, IDFV, Android ID, and Advertising ID), hardware specifications, screen resolution, device language and regional settings, and time zone. We also collect network information including your IP address, connection type (WiFi, cellular, 3G, 4G, 5G), mobile carrier, and network performance data.
2.7. App Usage Information. We automatically collect information about how you use the App including the App version, installation date, first and last access dates, session duration and frequency, features used, screens viewed, navigation patterns, in-app searches, and content interactions such as views, likes, saves, and shares.
2.8. Workout and Performance Data. We collect data about your workout activities including classes started, paused, and completed, workout duration and completion rates, exercise performance metrics, streaks and achievements, calendar and scheduling data, and reminder interactions.
2.9. Technical Data. We collect technical information including crash reports and error logs, performance diagnostics, debug information, and API response times to ensure the App functions properly and to improve our Services.
2.10. Push Notifications. If you enable push notifications, we store a unique Push Token for your device, track notification delivery and interaction, and record your notification preferences. You may disable notifications at any time through your device settings.
2.11. Information from Third Parties. We may receive information from social login providers (such as Google, Apple, or Facebook) if you choose to register via these services, as well as from analytics providers, advertising partners, and app stores for purchase verification purposes.
2.12. Health and Fitness Platform Integration. With your explicit consent, we may access data from Apple HealthKit, Google Fit, or other connected fitness devices and wearables. This data may include steps, heart rate, calories burned, sleep data, and other fitness metrics. You may revoke this access at any time through your device settings.
3. HOW WE USE YOUR INFORMATION
3.1. Service Provision. We use your information to create and manage your account, provide access to workout content, personalize workout recommendations based on your goals and fitness level, track your fitness progress, process subscriptions and purchases, and enable the features and functionality of the App.
3.2. Personalization. We use your information to customize content based on your goals, preferences, and fitness level, recommend relevant workout programs, adjust difficulty levels appropriately, provide personalized tips and insights, and create tailored workout schedules designed to help you achieve your fitness objectives.
3.3. Communication. We use your information to send service-related notifications, provide workout reminders, respond to your inquiries and support requests, send promotional content (with your consent), and deliver important updates and announcements regarding the App and our Services.
3.4. Improvement and Development. We use your information to analyze usage patterns and trends, improve App functionality and user experience, develop new features and content, conduct research and analytics, and test new functionalities before release.
3.5. Safety and Security. We use your information to detect and prevent fraud, protect against unauthorized access, ensure platform integrity, enforce our Terms of Service, and comply with our legal obligations.
3.6. Legal and Business Purposes. We use your information to comply with applicable laws and regulations, respond to legal requests and court orders, protect our rights and property, and facilitate business transactions such as mergers, acquisitions, or sales.
4. LEGAL BASIS FOR PROCESSING
4.1. We process your personal data based on the following legal grounds: (a) Consent, when you provide explicit consent for specific processing activities; (b) Contract, when processing is necessary to fulfill our agreement with you and provide the Services; (c) Legal Obligation, when required by applicable laws and regulations; and (d) Legitimate Interest, when processing serves our legitimate business interests without overriding your fundamental rights and freedoms.
5. DATA SHARING AND DISCLOSURE
5.1. Service Providers. We share data with third-party service providers who assist in operating our Services. These include Firebase (Google) for authentication, database management, cloud storage, analytics, crash reporting, and push notifications; Apple App Store for payment processing, subscription management, and purchase verification on iOS devices; Google Play Store for payment processing, subscription management, and purchase verification on Android devices; cloud hosting providers for data storage and processing; email service providers for transactional and marketing communications; analytics providers for usage analysis and performance monitoring; and customer support platforms for inquiry management. All service providers are contractually obligated to protect your data and use it only for the purposes we specify.
5.2. Legal Disclosures. We may disclose your information when required to comply with laws, regulations, or legal processes; to respond to lawful requests from public authorities including law enforcement or national security agencies; to protect our rights, privacy, safety, or property; to enforce our Terms of Service; and to protect against legal liability.
5.3. Business Transfers. In the event of a merger, acquisition, reorganization, sale of assets, or bankruptcy, user information may be transferred to the acquiring entity as part of the transaction. We will notify you of any such transfer and any choices you may have regarding your information.
5.4. With Your Consent. We may share your information with third parties when you provide explicit consent for such sharing.
5.5. Aggregated and Anonymized Data. We may share aggregated, anonymized, or de-identified data that cannot reasonably be used to identify you with third parties for research, analytics, marketing, or other purposes without restriction.
5.6. No Sale of Personal Data. We do not sell your personal information to third parties for monetary compensation.
6. DATA SECURITY
6.1. We implement and maintain reasonable and appropriate technical, administrative, and physical security measures designed to protect your information from unauthorized access, disclosure, alteration, and destruction. These measures include encryption of data in transit using TLS/SSL protocols, encryption of data at rest, secure authentication mechanisms, password hashing, access controls limiting data access to authorized personnel only, regular security assessments and audits, secure development practices, and regular data backups.
6.2. Despite our efforts, no method of transmission over the Internet or method of electronic storage is completely secure. We cannot guarantee absolute security of your information, and you acknowledge that you provide your information at your own risk.
6.3. In the event of a data breach affecting your personal information, we will notify affected users and relevant authorities in accordance with applicable laws and regulations.
7. DATA RETENTION
7.1. We retain your personal information for as long as your account is active or as needed to provide you with our Services. Following account closure or deletion request, we will delete or anonymize your information within ninety (90) days, except for information that we are required or permitted to retain for legal, regulatory, fraud prevention, or legitimate business purposes.
7.2. Specific retention periods may apply to certain categories of data: account information is retained for the duration of your account plus the legally required period thereafter; transaction records are retained for the period required by applicable tax and accounting laws; usage data may be retained in anonymized form indefinitely for analytics purposes; and communication records are retained as necessary to resolve disputes and enforce our agreements.
7.3. Anonymized or aggregated data that cannot be used to identify you may be retained indefinitely for research, analytics, and service improvement purposes.
8. YOUR RIGHTS AND CHOICES
8.1. Subject to applicable law, you have certain rights regarding your personal information. These include the right of access, which allows you to request confirmation of whether we process your personal data and to obtain a copy of such data; the right of rectification, which allows you to request correction of inaccurate or incomplete personal data; the right of erasure, which allows you to request deletion of your personal data under certain circumstances; the right to object, which allows you to object to processing of your personal data for certain purposes including direct marketing; the right to restriction, which allows you to request restriction of processing under certain circumstances; and the right to data portability, which allows you to receive your personal data in a structured, commonly used, machine-readable format.

8.3. You may delete your account at any time through the App settings or by contacting us directly. Upon account deletion, we will delete or anonymize your personal information as described in Section 7.
8.4. Withdrawal of consent for certain processing activities may affect our ability to provide you with some or all of our Services.
9. MARKETING COMMUNICATIONS
9.1. With your consent, we may send you promotional communications including information about new features, content, special offers, and other information we think may interest you. You may opt out of receiving marketing communications at any time by clicking the "unsubscribe" link in any marketing email, adjusting your notification preferences in the App settings, or contacting us directly.
9.2. Even after opting out of marketing communications, we may still send you non-promotional messages relating to your account, purchases, subscriptions, or our ongoing business relationship.
10. CHILDREN'S PRIVACY
10.1. The App is not intended for children under the age of sixteen (16). We do not knowingly collect personal information from children under 16. If you are a parent or guardian and believe that your child has provided us with personal information without your consent, please contact us immediately. If we become aware that we have collected personal information from a child under 16 without verification of parental consent, we will take steps to delete that information as quickly as possible.
11. INTERNATIONAL DATA TRANSFERS
11.1. Your information may be transferred to, stored, and processed in countries other than your country of residence, including the United States, European Union member states, and other jurisdictions where our service providers operate. These countries may have data protection laws that differ from the laws of your country.
11.2. By using the App, you consent to the transfer of your information to countries outside your country of residence, including countries that may not provide the same level of data protection as your home country. We will take appropriate measures to ensure that your personal information remains protected in accordance with this Privacy Policy.
12. THIRD-PARTY LINKS AND SERVICES
12.1. The App may contain links to third-party websites, applications, or services that are not operated by us. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services. We encourage you to review the privacy policies of any third-party sites or services that you visit or use.
13. TRACKING TECHNOLOGIES
13.1. We and our service providers use various tracking technologies including device identifiers, software development kits (SDKs), and similar technologies to collect and store information about your use of the App. These technologies help us analyze trends, administer the App, track user movements within the App, and gather demographic information about our user base.
13.2. You may be able to reset or limit the use of certain identifiers through your device settings, such as resetting your Advertising ID or limiting ad tracking. Please note that limiting tracking technologies may affect the functionality of certain features of the App.
14. CALIFORNIA PRIVACY RIGHTS
14.1. If you are a California resident, you may have additional rights under the California Consumer Privacy Act (CCPA) including the right to know what personal information we collect, use, disclose, and sell; the right to request deletion of your personal information; the right to opt out of the sale of your personal information (note: we do not sell personal information); and the right to non-discrimination for exercising your privacy rights. 15. LIMITATION OF LIABILITY
15.1. We are not responsible for any damages that may result from unauthorized access to your account or from disclosure of your login credentials to third parties. We are not liable for any use of your information by third parties or as a result of security breaches beyond our reasonable control. Your use of the App and provision of information is at your own risk.

17. GOVERNING LAW AND JURISDICTION
17.1. This Privacy Policy shall be governed by and construed in accordance with the laws of the State of Israel, without regard to its conflict of law principles.
17.2. Any dispute arising out of or relating to this Privacy Policy shall be subject to the exclusive jurisdiction of the competent courts located in the Tel Aviv-Jaffa district, Israel.
17.3. By downloading, installing, or using the App, you consent to the exclusive jurisdiction and venue of such courts and waive any objection to such jurisdiction or venue.
